BLUE SPIKE CONTEST RULES
1A. TO ENTER online, visit www.octanebev.com and fully complete the online contest entry form which includes; Full name (first and last name), complete mailing address, telephone number, email address and participating unique pin code. Once complete click "Submit" and you will be automatically entered into the contest. Limit one (1) entry per person per day for the duration of the contest period.
2. NO PURCHASE NECESSARY mail-in entry. On a blank piece of paper legibly print or type your Full name (first name, last name), complete address (including postal code), daytime telephone number (including area code), contest name and email address (if applicable) and mail it to the following address: Blue Spike Fly to Barcelona contest, 4398 St-Laurent, suite 101, Montreal, Quebec, H2W 1Z5 Limit one (1) no purchase necessary mail in entry per household per day. Mail-in entries postmarked no later than Friday August 29th, 2008 and be received no later than Friday September 5th, 2008 will be automatically included in the Grand Prize Draw. All mail in entries received after Friday August 29th, 2008 will be ineligible.
3. To be eligible to win a Prize in Blue Spike Beverages Fly to Las Vegas contest you must be a resident of Canada and have reached the legal drinking age in the province/territory in which you reside on or before the Contest Closing Date. Submissions through groups and/or charities will not be accepted.
4. The Sweepstakes commences on or around 12:00AM Eastern Time (ET) on Wednesday May 21st, 2008 and closes 11:59PM (ET) Friday September 5th, 2008. An independent judging organization will conduct one (1) random Grand Prize draw at approximately 10:00AM ET, on Monday September 8th, 2008 (ET) in Montreal QC.
5. The odds of being selected depend upon the total number of eligible entries received for the Grand Prize Draw.
6. There will be five (3) Grand Prizes available to be won consisting of(4 day 3 night) trip to Las Vegas, USA. The approximate value of one grand prize is $1500 CA. This prize includes:
1. return economy airfare departing from the Canadian international airport nearest the winner's residence Las Vegas Airport (departure and destination airports, carrier and airline ticket class to be chosen by the Sponsor in its sole discretion);
2. Three (3) nights accommodation at a three star hotel property in the city of Las Vegas (to be selected by Blue Spike Beverages), in a standard room, based on double occupancy;
All other expenses not specified herein, including but not limited to: ground transportation; meals; airport taxes; telephone, fax or cable charges; personal services and expenses such as laundry, valet, room service; gratuities; optional tours; insurance; medical travel documents; and other incidental costs and any other costs not specifically stated herein as being included, are the responsibility of the prize winner and his/her guest. The prize winner and his/her guest must have a valid passport at the time of their departure. The prize winner and his/her guest are responsible for all required medical and travel related necessities (including inoculations) and documentation. A valid major credit card may be presented upon check-in. The prize winner and his/her guest must travel together. If the travel companion is a minor, his/her parent or legal guardian must also sign a Consent and Release. Winner and guest must travel within one (1) year of being declared the Grand Prize. Blue Spike Beverages will not be responsible if event cancellations or other factors beyond their reasonable control prevent the Grand Prize or any part of the Grand Prize from being fulfilled. In any such event, the Grand Prize winner will not be provided with a substitute or cash equivalent for the Grand Prize, or any such part of the Grand Prize. Blue Spike Beverages makes no express or implied warranties or conditions of any kind with respect to safety, appearance or performance of any prize or prize activity offered.
7. Grand Prize Confirmation: Starting Tuesday, September 9th, 2008, attempts will be made to contact the entrant selected as eligible for the Grand Prize at the telephone number on their entry form between 9:00AM and 5:00PM for a period of 7 business days. If the eligible entrant cannot be contacted in person within the allotted time, he/she is no longer eligible to win and another entrant will be drawn where the same process will be repeated, until the Prize has been successfully awarded. No communication will be entered into except with the selected entrant.
8. To be declared a Grand Prize winner, the selected entrant must first correctly answer, unaided, a time-limited, mathematical skill-testing question, posed by telephone at a mutually convenient time. The Grand Prize winner and (if applicable) Travel Partner must sign a Release and Indemnity form confirming understanding, compliance with and acceptance of the contest rules and acceptance of the Grand Prize and a release of all liability satisfactory to the Contest Sponsor(s), before being declared the Grand Prize winner. The Contest Sponsor rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.
9. Directors, officers, employees and agents of Blue Spike Beverages Inc. (the "Sponsor"), their respective partners, affiliates, subsidiaries, suppliers, printers, and distributors, and all persons with whom they are domiciled, are not eligible to participate in this contest.
10. All entry forms become the property of the Sponsor and will not be acknowledged or returned. The Sponsor will not be responsible for entry forms delayed, stolen, misdirected, lost or destroyed.
11. Prizes cannot be transferred to another person. Prizes can be substituted for a cash payment of $1500. All incremental costs in using or claiming a Prize not outlined in this prize description are the sole responsibility of the Prize winner.
12. Entry forms shall be subject to verification and shall be null and void if they are found to not have been submitted in accordance with these contest rules.
13. Subject to the approval of the Régie des alcools des courses et des jeux du Québec the Contest Sponsor reserves the right to withdraw or terminate this contest at any time without prior notice or obligation, subject to applicable laws.
14. For Québec residents, any litigation regarding the conduct reorganization of a publicity contest may be submitted to the Régie des alcools des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
15. Canadian Residents (excluding Quebec) : any complaints can be filed with the Competition Bureau of Canada. Any dispute should be submitted to the Competition Bureau of Canada so that they can assist the parties in reaching an amicable settlement.
16. Privacy Statement: Personal information collected during the administration of this Contest will only be used in conjunction with executing the terms of this Contest unless an entrant has lawfully consented to the use of their personal information, as outlined in the Personal Information Protection and Electronics Documents Act (Canada), for the purpose(s) listed at the time of consent. The declared Prize Winner's information will be shared with the Contest Sponsor and the independent Contest judging organization selected by the Sponsor, specifically the Prize winner's name, mailing address, telephone number and/or e-mail address, only as this information is required to award the Prizes for this Contest.
17. No responsibility is assumed by Blue Spike Beverages Inc., its affiliates, subsidiaries, agencies, their respective directors, officers, nor employees and assigns, for any disruption to telephone network or lines, computer on-line systems, servers or providers, computer equipment, software or failure of any entry to be received because of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, as well as lost, stolen, misdirected, destroyed, illegible, delayed or late entries which for any reason are not received.
18. The Sponsor reserves the right, in its sole discretion; subject to the approval of the Régie des alcools des courses et des jeux du Québec, and the Competition Bureau of Canada to cancel or suspend the email portion of this contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, The Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
19. No liability or responsibility is assumed by Blue Spike Beverages Inc., resulting from user attempts to participate in this Contest, or if required, download any information necessary to participate in this contest. In the event of a dispute regarding who submitted an on-line entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry.
20. By accepting a Prize in this Contest, the Prize winner agrees to hold the Sponsor, their affiliates, subsidiaries, agencies, their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of or in any way connected with the operation of this Contest and use of a Prize. The Prize Winner assumes all liability for any injury, or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of a Prize. By participating in this Contest, entrants agree to be bound by the Official Contest Rules & Regulations and the decisions of the Contest judges selected by the Sponsor.
21. By entering this Contest all entrants, should they win, agree to use of their name, address (city only), photo and/or image on videotape for publicity purposes relating exclusively to this contest to this contest without compensation. Blue Spike Beverages Inc. reserves the right to disqualify any individual who finds it to be in violation of these Official Contest Rules and Regulations or tampering with the entry process. Blue Spike Beverages Inc. reserves the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter. Any attempt by anyone to deliberately undermine the legitimate operation of this Contest is in violation of criminal and civil laws and Blue Spike Beverages Inc. reserves the right to seek damages or other legal remedy to the fullest extent permitted by law.
22. This contest and the terms and conditions contained in these Official Contest Rules and Regulations, shall be exclusively governed by and construed in accordance with the laws of the Province of Quebec, Canada and the federal laws of Canada applicable therein. Any dispute arising hereunder shall be adjudicated solely in the applicable court in Montreal, Quebec, Canada.
23. Where applicable, this Contest is subject to all federal, provincial and municipal laws. Decisions are final in respect to all aspects of this contest.
